New York Independent System Operator, Inc.)Docket Nos.   EL07-39-004

)EL07-39-005

)ER08-695-002

)ER08-695-003

MOTION FOR FURTHER LIMITED EXTENSION OF TIME AND FOR SHORTENED
NOTICE AND COMMENT PERIOD AND FOR EXPEDITED ACTION OF

THE NEW YORK INDEPENDENT SYSTEM OPERATOR, INC.

Pursuant to Rules 212 and 2008 of the Commission’s Rules of Practice and Procedure,1
the New York Independent System Operator, Inc. (“NYISO”) respectfully submits this motion
for a brief extension of time to submit its compliance tariff revisions in response to the
Commission’s May 20, 2010 order in the above captioned proceedings (“May 20 Order”).2
Specifically, the NYISO asks that it be given until August 12, 2010 to submit compliance
language so that it may first post draft tariff sheets for its stakeholders’ information and so that it
may have an opportunity to respond to stakeholder questions concerning the posted materials.
The NYISO is in the process of completing its development of a complete set of
compliance tariff revisions in response to the May 20 Order but has not yet had an opportunity to
make it available to its stakeholders.  Granting the brief requested extension will thus allow
stakeholders to consider the NYISO’s proposal and permit the NYISO to conduct a “question
and answer” conference call before making the compliance filing.3  The NYISO respectfully
submits that no party’s interests would be harmed if its request were granted.

1 18 C.F.R. §§ 385.212 and 385.2008 (2009).

2 New York Independent System Operator, Inc., 131 FERC ¶ 61,170 (2010) (“May 20 Order”).

3 Under the NYISO’s “shared governance” model, stakeholder votes are not required in advance of

compliance filings, as opposed to filings under Section 205 of the Federal Power Act, but the NYISO often provides advance notice of compliance filing materials as a courtesy to stakeholders.

To the extent necessary, the NYISO respectfully requests that the Commission shorten its usual comment period and act expeditiously so that an order on this Motion may be issued no later than July 29, 2010.  Expedited action will provide the NYISO with certainty regarding the deadline for compliance with the May 20 Order’s requirements and allow it to proceed in an orderly manner.  This extension request will be posted on the NYISO’s website and a notice of that posting will be sent to the NYISO’s Market Participants.

Respectfully submitted,

/s/  Ted J. Murphy
