Notice of Cancellation of Cost Reimbursement Agreement with New York Power Authority

Dear Secretary Bose:

 

Pursuant to Section 35.15 of the Federal Energy Regulatory Commission’s

(“Commission”) regulations,1 Niagara Mohawk Power Corporation (“Niagara Mohawk”) submits for Commission acceptance this Notice of Cancellation of a Cost Reimbursement Agreement (“Reimbursement Agreement”) with the New York Power Authority
(“NYPA”).2  Niagara Mohawk is cancelling the Reimbursement Agreement because the project described in the Reimbursement Agreement has ended and all invoicing under the agreement has been completed.

Niagara Mohawk respectfully requests that the Commission accept this Notice of Cancellation effective as of November 22, 2016.

 

I.Background and Justification for Cancellation

The Reimbursement Agreement is a contract between Niagara Mohawk and

NYPA intended to facilitate the elimination of potential line clearance issues regarding NYPA transmission facilities that pass above structures owned or operated by Niagara Mohawk.  In 2013, the Commission accepted for filing Niagara Mohawk’s submittal of the Reimbursement Agreement and granted Niagara Mohawk’s requested effective date of November 9, 2012.3

The project described in the Reimbursement Agreement has ended and all

invoicing under the agreement has been completed.  Therefore, the Reimbursement

Agreement is no longer required.  Niagara Mohawk respectfully requests that the

Commission accept this Notice of Cancellation effective as of November 22, 2016, i.e.,

61 days after the date of this filing.
