On December 12, 2014, the Federal Energy Regulatory Commission (“Commission” or
“FERC”) Office of Energy Policy and Innovation (“OEPI”) issued a data request to the New
York Independent System Operator, Inc. (“NYISO”) in the above-referenced docket (the “Data
Request”).  The Data Request seeks information and data regarding “the impact on reliable and
efficient operations of natural gas-fired generators running out of their daily nomination of
natural gas transportation service during the morning electric ramp, to the extent this occurs.”1
The NYISO has included its written responses to the Data Request with this filing letter.

To supplement some of its written responses to the Data Requests, the NYISO has

submitted herewith two appendices that contain supporting data: Appendix A and Appendix B.
Each of the appendices contains some confidential information for which NYISO is asserting a
claim of privilege pursuant to 18 CFR § 388.112.  The privileged information is in the Appendix
A “Total De-rate” column, which specifies the total MW de-rated for an hour, and the Appendix
B “Amount De-rated” column, which identifies the MW de-rate by generator in each hour.  The
data in these columns could identify the specific generator that was de-rated, thus revealing

certain fuel supply or operating characteristics of the generator, and has been redacted from the NYISO’s public filing.  A non-privileged summary of the redacted data follows.

The appendices list 320 hours during 2013 and 2014 when natural-gas fired generators located in New York were de-rated as a result of fuel availability and related issues.2  The
privileged data that has been redacted from the public versions of the appendices identifies an average de-rate of 93 MW/hour, a maximum de-rate of approximately 577 MW/hour and a
minimum de-rate of approximately 6 MW/hour.3  Eighty-nine of these hours involved de-rates of more than 100 MW and 147 of these hours involved de-rates of more than 25 MW but less than 100MW.  The remaining 84 hours involved de-rates of less than 25 MW.

In accordance with 18 CFR § 388.112 and Section 12.4 of the NYISO’s Code of

Conduct,4 the NYISO hereby requests privileged treatment and an exemption from disclosure
under the Freedom of Information Act (“FOIA”) (5 U.S.C. § 552) for the de-rate, in MW, data
contained in the “Total De-rate” column of Appendix A and in the “Amount De-rated” column
of Appendix B.  A significant number of the hours with natural-gas fired generator de-rates,
more than one-third, involved only one generator.  The affected generators could be identified by
the number of MWs de-rated when the de-rate MW value equals a generator’s total capability
(which occurred in many instances).  The public disclosure of such information could place the
owners of the de-rated generators at a competitive disadvantage, vis-à-vis natural gas suppliers
and other entities that participate in the energy markets administered by the NYISO, at times
when natural gas supplies are scarce.  The NYISO has redacted the privileged data from the
Public version of the appendices.  The complete appendices are only included in the Privileged
versions, which are labeled CONTAINS PRIVILEGED INFORMATION—DO NOT
RELEASE.

The NYISO respectfully requests that, in the event the Commission receives a FOIA request pertaining to the NYISO’s privileged responses, the Commission protect the

RESPONSE OF THE NEW YORK INDEPENDENT SYSTEM OPERATOR,
INC. TO DATA REQUESTS

1. During 2013 and 2014, how many times and during which months did

natural gas-fired generators notify NYISO system operations that they

were unavailable to run or had to reduce their output (i.e., de-rate)?  How many times did they provide the above notification between the hours of 3:00 a.m. Central Time and 9:00 a.m. Central Time?

NYISO Response to Question 1:

a. Natural gas-fired generators that lack dual-fuel capacity notified NYISO
system operations that they were unavailable to run or had to reduce
their output 20,784 times during 2013 and 2014.  They notified NYISO
system operations in all 24 months of the reporting period.

b. Between 3:00 a.m. Central Time and 9:00 a.m. Central time, NYISO
system operations received 4,966 notifications.

2. During 2013 and 2014, on which dates did natural gas-fired generators

notify NYISO system operations that they had to de-rate during the hours
of 3:00 a.m. Central Time and 9:00 a.m. Central Time due to the
generators having exhausted their daily nomination of natural gas
transportation service prior to the end of the Gas Day?  For each day,
provide, for each hour 3:00 a.m. Central Time through 9:00 a.m. Central
Time, (a) the total MW/hour de-rated; (b) number of generators de-rated;

(c) total system load in MW/h; (d) the level of effective operating reserves in MW available to the RTO.  In your answer, please define the morning ramp period for your region.

NYISO Response to Question 2:

During the winter season in New York, the morning ramp period occurs between 6:00 a.m. and 9:00 a.m. Eastern Standard Time, which is 5:00 a.m. through 8:00 a.m. Central Time.

Appendix A to the NYISO’s responses provides a list of dates on which
natural gas-fired generators submitted notifications relating to fuel
availability and related issues, during 2013 and 2014 between the hours
of 3:00 a.m. Central time and 9:00 a.m. Central time.  The list includes
total MW/hour de-rated, number of generators de-rated, total system
load, and the level of effective operating reserves for each hour.

i. For each day, for those generators identified in 2(b) above, specify

the number of generators that were committed in the day-ahead
market, but did not provide power at their day-ahead scheduled
level.

NYISO Response to Question 2(i):

Please see the “Number of Generators Committed Below DAM
Schedule” and “Number of Generators Committed Above DAM
Schedule” data fields in Appendix A to the NYISO responses.

ii. For each day, for those generators that comprise your response in

2(b) above, specify the number of generators that had received a
real-time dispatch instruction to increase their power output from
their day-ahead schedule.  Also, provide the hour at which the real-
time dispatch instruction was issued.  For each occurrence provide
the difference between the generator’s day-ahead schedule and the
ISO’s real-time dispatch instruction for those units that de-rated.

NYISO Response to Question 2(ii):

The NYISO’s Real-Time Commitment (RTC) performs an economic
evaluation and issues advisory schedules every 15 minutes.  RTC can
commit fast start GTs.  The NYISO’s Real-Time Dispatch (RTD) issues
revised dispatch instructions every five minutes.  For the number of
generators that received a real-time dispatch instruction to increase their
power output from their day-ahead schedule, on an average hourly level,
please see the “Number of Generators Committed Above DAM
Schedule” data field in Appendix A to the NYISO’s responses.  For the
difference between a generator’s day-ahead schedule and its average
hourly real-time dispatch instruction, please see the “Difference Between

Day Ahead Schedule and RT Schedule” data field in Appendix B to the NYISO’s responses.  This field is presented as the average hourly realtime dispatch instruction minus the day-ahead scheduled MWs.

iii. To the best of your knowledge, for each date of occurrence, specify

the non-confidential system conditions on the relevant interstate

natural gas pipeline(s) or Local Distribution Companies (LDCs), if applicable, that restricted transportation to the generator at the time the natural gas-fired generator(s) notified NYISO system operations that they were unavailable or had to de-rate (e.g., were pipeline
Operational Flow Orders in effect)?

NYISO Response to Question 2(iii):

Appendix A to the NYISO responses sets forth the OFO information that
the NYISO received through email notifications from gas pipelines and
LDCs.  The NYISO performed a search of email notifications to identify
the best OFO information it had available.  The OFO information
included in Attachment A may not be a comprehensive list of all
responsive system conditions that occurred on all of the relevant
interstate natural gas pipeline(s) or LDCs over the reporting period.

iv. If during any of these occurrences NYISO took extraordinary action

to maintain adequate operating reserves, indicate the date and time, the actions taken and the MW/hour of relief obtained.

NYISO Response to Question 2(iv):

The generators identified in the table below were committed via SRE on
days with de-rates greater than 225 MW in any hour.  Given the times
the SREs occurred, it is not clear that any of the SREs were issued in
response to a generator de-rating due to having exhausted its daily
nomination of natural gas transportation service prior to the end of the
gas day.  Instead the de-rates were more likely related to limitations on
natural gas customers’ ability to receive/take gas, such as OFOs which
require gas customers to operate within tight tolerances, or generator-
specific issues that might, or might not, be related to the availability of
gas supply.

v. What were the operational and cost impacts of the occurrences?

NYISO Response to Question 2(v):

The NYISO is not able to determine the in-market costs of these

occurrences.  The NYISO re-dispatches its system to minimize

production costs every five minutes.  The NYISO’s least production cost
re-dispatch addresses numerous, continuously changing conditions that
occur on its system.  The costs of the specific occurrences the
Commission is inquiring about cannot be accurately distinguished from
the costs of responding to other system reliability needs that the
NYISO’s dispatch was also responding to.  However, the out of market,
uplift costs paid to the resources that are listed in the NYISO’s response
to question 2(iv) above totaled $1,691,144.44; some portion of which
was likely related to addressing reliability limitations on the gas system.

3. Do the generators that comprise your response to 2(b) above share any

common characteristics?  For example, do natural gas-fired generators

located on certain interstate natural gas pipelines de-rate more frequently? Do smaller natural gas-fired generators de-rate more frequently than
larger natural gas-fired generators?

NYISO Response to Question 3:

The NYISO did not identify any relevant common characteristics among the specified units.

4. How often has NYISO committed generation out of merit order in

anticipation of natural gas-fired generators running out of their nominated gas transportation at the end of the Gas Day?

NYISO Response to Question 4:

Please see the NYISO’s response to question 2(iv) above.

5. Please describe any efforts NYISO has made to minimize the risk that
natural gas-fired generators may run out of natural gas during the
morning electric ramp.

NYISO Response to Question 5:

If a natural gas-fired generator that was committed in the Day-Ahead

Market believes that it is at risk for running out of natural gas during the
morning electric ramp, it may use the increase bids in real-time (IBRT)
functionality to incorporate this risk, or any other opportunity costs, into
its real-time energy offer.  Generators that are offering into the Real-
Time Market can similarly incorporate legitimate gas availability risks
into their offers.  When a generator needs to procure and nominate
additional gas at a premium compared to the cost of previously procured
and nominated gas, or needs to rely on approved gas balancing with the
pipeline or LDC, the generator may reflect either cost in its energy offer
and/or include the additional cost in its reference level through a Fuel
Type Update (to reflect a fuel type switch) or a Fuel Price Update.  By
reflecting these higher costs, in many cases the resource may receive a
smaller Real-Time schedule and be dispatched down below its Day-
Ahead schedule, with a lower cost resource committed or dispatched up
in its place.  If a generator is dispatched down below its Day Ahead
schedule, the generator must buy out of its Day-Ahead schedule at the
Real-Time price.
