REQUEST OF THE NEW YORK INDEPENDENT SYSTEM OPERATOR, INC.
FOR LEAVE TO SUBMIT LIMITED ANSWER OUT-OF-TIME

In accordance with Rules 212 and 2008 of the Commission’s Rules of Practice and

Procedure, the New York Independent System Operator, Inc. (“NYISO”), respectfully requests, that the Commission accept, to the extent that the Commission deems necessary, the NYISO’s filing of its Request for Leave to Submit Limited Answer and Limited Answer of the New York Independent System Operator, Inc. (“Limited Answer”) out of time.

Consistent with Commission Rules 213 and 2007, NYISO’s outside counsel sought to
file the Limited Answer before 5:00 PM on October 21. Due to an unexpected software
scanning issue only a portion of the Limited Answer was successfully e-filed at 4:35:46 PM
(Attachment 1). Shortly afterwards, outside counsel discovered that a portion of the Limited
Answer was not included in the scanned version that was filed before 5:00 PM. It promptly re-
submitted the entire Limited Answer but did not complete the re-submission until 5:11:24 PM
(Attachment 2). Consequently, the re-submitted version of the Limited Answer has been
assigned a “Filed Date” of October 22, 2013. The complete version of the Limited Answer was
timely served on all parties to this proceeding and on other NYISO stakeholders on October 21.
Therefore, to the extent necessary, the NYISO respectfully asks that the Commission exercise its discretion to accept the Limited Answer out-of-time. Given the ministerial nature of

the underlying error, and the fact that the error was corrected quickly, no party would be prejudiced if the Commission were to grant the NYISO’s request.
