Pursuant to Section 35.13 of the Federal Energy Regulatory Commission’s

(“Commission”) regulations (18 C.F.R. § 35.13), Consolidated Edison Company of New York,
Inc. (“Con Edison” or “the Company”) submits for filing tariff revisions to the New York
Independent System Operator, Inc. (“NYISO”) Open Access Transmission Tariff (“OATT”) to
adjust certain entries in Section 14.3 Attachment H-1 of the NYISO OATT to reflect the
expiration of Pre-OATT Grandfathered Agreements listed in that section of the OATT.

 

Documents Submitted

 

1.  This filing letter;

2.  A clean version of the proposed revisions to the NYISO OATT; and

 

3.  A blacklined version of the proposed revisions to the NYISO’s OATT.

 

 

Background

The NYISO Wholesale Transmission Service Charge (“TSC”) is calculated pursuant to
Section 14.1 of the NYISO OATT.   The TSC is a charge to wholesale customers equal to the
Revenue Requirement of each New York Transmission Owner (“ NY TO” or “Company”)
adjusted by several factors, and includes revenues from grandfathered rights under Pre-OATT

Grandfathered Existing Transmission Agreements (“Pre-OATT Grandfathered Agreements” or “Existing Transmission Agreements” or “ETAs”) listed in Attachment L of the NYISO OATT. These revenues (“grandfathered rights revenues”) are treated as revenue credits in developing the revenue component of each Company’s TSC Rate.    The ETAs and the associated grandfathered rights revenues are listed in Section 14.3 of the OATT.

 

ProposedTariff Changes

 

The purpose of this filing is to update section 14.3 and eliminate the Pre-OATT

Grandfathered Agreements for Consolidated Edison Company of New York, Inc. (“Con

Edison”) that have expired.   The Con Edison Pre-OATT Grandfathered Agreements that are

used to calculate the grandfathered rights revenues for the Con Edison TSC are listed at Section

14.3.6 of the OATT.  The expired Pre-OATT Grandfathered Agreements (by Rate Schedule number) that are being eliminated from section 14.3.6 by this filing are as follows:

Section 35.13 Requirements

Con Edison respectfully requests a waiver of the Commission’s regulations regarding filing requirements (18 C.F.R. § 35.13) to the extent that these sections are applicable to the enclosed filing and to the extent that the material submitted in this filing may fail to comply precisely with those requirements.

Proposed Effective Date

Con Edison requests that the proposed tariff amendments be accepted and that they be made effective sixty days from the date of this filing.
