Dear Secretary Bose,

In its October 4, 2013 Letter Order in the above-referenced docket, the Federal Energy
Regulatory Commission (the “Commission”), approved the uncontested Offer of Settlement
(“Settlement”) filed by the New York Power Authority (“NYPA”).  As part of its approval of the
Settlement, the Commission’s Letter Order directed NYPA to work with the New York
Independent System Operator, Inc. (“NYISO”) to file within 30 days identical revisions to
Section 14.2.2.4.1 of Attachment H of the NYISO’s Open Access Transmission Tariff (“OATT”)
in e-Tariff format.

 

In compliance with the Letter Order, NYPA, working in collaboration with the NYISO, hereby supplies revised tariff records in eTariff format.  In accordance with the Letter Order, such revised records are made effective August 1, 2012.

A.  This transmittal letter;

B.  Clean tariff records reflecting the revisions to the OATT discussed herein
(Attachment I); and

C.  Redlined tariff records reflecting the revisions to the OATT discussed herein

III.Service List

NYPA, in coordination with NYISO, will electronically serve a copy of this filing on all
persons on the official service list in this proceeding as well as the official representative of each
of the NYISO’s customers, on each participant in the NYISO’s stakeholder committees, on the
New York State Public Service Commission and the New Jersey Board of Public Utilities.

 

IV. Description of Proposed Tariff Changes

 

NYPA proposes to make the following changes to the NYISO OATT in compliance with the Letter Order:

 

Section 14.2.2.4.1 (“Amended RR”), which contains NYPA’s Amended Annual

Transmission Revenue Requirement of NYPA effective August 1, 2012, would be changed from $183,096,025, the amount that was conditionally accepted by the Commission in its September 25, 2012 order1, to $175,500,000, the amount contained in the approved Settlement.

Accordingly, the revised Section 14.2.2.4.1 would read as follows: “14.2.2.4.1Amended RR

NYPA’s Amended Annual Transmission Revenue Requirement (Amended RR), effective August 1, 2012, is:

 

Amended RR = $175,500,000”

 

V.Effective Date

In compliance with the Commission’s approval of the Settlement, the above-described NYISO OATT changes become effective August 1, 2012.

VI.Other Settlement Matters

In accordance with the Settlement, NYPA will work with the NYISO to process refunds
to customers based on the difference between the revenues collected under the conditionally
approved revenue requirement and the Settlement revenue requirement.  Such refunds will
commence on the first possible NYISO billing month subsequent to the date of this filing.

 

VII.   Conclusion

Wherefore, for the foregoing reasons, NYPA respectfully requests that the Commission accept the amended tariff records filed herein.
