Dear Mr. Schnell:

Pursuant to the authority delegated to the Director, Division of Electric Power Regulation – East, under 18 C.F.R. §375.307, your submittal filed in the above referenced docket is accepted for filing effective June, 30, 2011.   

On June 7, 2010, as amended June 16, 2010, New York Independent System Operator, Inc. (NYISO) submitted revisions to section 23 of NYISO Market Services Tariff (Section 23 Revisions) to reflect an effective date of June 30, 2011.  These revisions were made in compliance with a February 10, 2011 delegated letter order[1] that accepted the Section 23 Revisions as of late June, 2011, and directed NYISO to inform the Commission when a specific effective date was known.  Your submittal satisfies this compliance obligation. 

Notice of the filings was made on June 8, 2011, and June 17, 2011, with comments, protests, or interventions due on or before June 28, 2011 and July 7, 2011, respectively.  No protests or adverse comments were filed. 

This acceptance shall not be construed as constituting approval of the referenced filing or of any rate, charge, classification, or any rule, regulation or practice affecting such rate or service provided for in the filed documents; nor shall such acceptance be deemed as recognition of any claimed contractual right or obligation associated therewith; and such acceptance is without prejudice to any findings or orders which have been or any which may hereafter be made by the Commission in any proceeding now or pending or hereafter instituted by or against NYISO. 

This order constitutes final agency action.  Requests for rehearing by the Commission may be filed within 30 days of the date of issuance of this order, pursuant to 18 C.F.R. §385.713.
