Dear Ms. Bluvas:

 

On May 20, 2010, you submitted on behalf of New York Independent System

Operator, Inc. (NYISO) revisions to its Market Administration and Control Area Services
Tariff (Tariff) to comply with the Commission’s April 23, 2010 Order.1  In compliance
NYISO clarifies that violations of the Commission’s orders, rules and regulations also
violate the NYISO tariff, deletes the final two sentences from Section 4.1.6a(2), and adds
the word "other" to Section 4.1.6a(3) consistent with the Commission's instructions.
Pursuant to the authority delegated to the Director, Division of Electric Power Regulation

- East, under 18 C.F.R. § 375.307 (2009), your submittal in the above-referenced docket is accepted, as designated, effective December 27, 2009.

Notice of NYISO’s compliance filing was published in the Federal Register with interventions and comments due on or before June 10, 2010.  No interventions, protests or adverse comments were filed.

 

This action does not constitute approval of any service, rate, charge, classification,
or any rule, regulation, contract, or practice affecting such rate or service provided for in
the filed documents; nor shall such action be deemed as recognition of any claimed
contractual right or obligation affecting or relating to such service or rate; and such action

is without prejudice to any findings or orders which have been or may hereafter be made
by the Commission in any proceeding now pending or hereafter instituted by or against
NYISO.

 

This order constitutes final agency action.  Requests for rehearing by the

Commission may be filed within 30 days of the date of issuance of this order, pursuant to

18 C.F.R. § 385.713 (2009).
