Reference: Compliance Filing Dear Mr. Murphy:

Pursuant to authority delegated to the Director, Division of Electric Power Regulation - East, under 18 C.F.R. § 375.307, your submittal filed in the above referenced docket is accepted for filing, effective January 17, 2010.

On March 4, 2010, New York Independent System Operator, Inc. (NYISO) filed Fifth Revised Sheet No. 780 and Third Revised Sheet No. 780A to its FERC Electric Tariff, Original Volume No. 1, Attachment X  in compliance with the
Commission’s February 17, 2010 Letter Order.1  NYISO was directed to file
appropriately designated tariff sheets that reflect the same effective date as the
tariff sheets accepted in Docket No. ER10-290-000, within 10 days of the date of
the issuance of the Commission’s order in that docket.  The Commission issued its order accepting tariff sheets in ER10-290-000 on February 22, 2010, with an
effective date of January 17, 2010.

Notice of the filing was published in the Federal Register with comments,
protests and interventions due on or before March 5, 2010.  No interventions,

comments or protests were filed.

This action does not constitute approval of any service, rate, charge,

classification, or any rule, regulation, contract, or practice affecting such rate or service provided for in the filed documents; nor shall such action be deemed as recognition of any claimed contractual right or obligation affecting or relating to such service or rate; and such action is without prejudice to any findings or orders which have been or may hereafter be made by the Commission in any proceeding now pending or hereafter instituted by or against NYISO.

This order constitutes final agency action.  Requests for rehearing by the Commission may be filed within 30 days of the date of issuance of this order, pursuant to 18 CFR § 385.713 (2009).
