On February 24, 2019, you submitted revisions to the New York Independent System Operator, Inc. (NYISO) Market Administration and Control Area Services Tariff (Services Tariff).  You state that these revisions are made in compliance with the Commission’s January 23, 2020 Order (January 2020 Order)[1] accepting NYISO’s proposal to amend its Open Access Transmission Tariff and Services Tariff to integrate Aggregations and distributed energy resources (DERs).  You also state that this compliance filing is intended to: (i) establish an effective date for tariff revisions for which the NYISO had previously not proposed an effective date; (ii) incorporate minor tariff revisions proposed by the New York Transmission Owners; and (iii) revise certain buyer-side mitigation tariff records reflecting the Commission’s December 20, 2019, Order in Docket No. ER19-467-000, et al.[2]  With respect to the Commission’s directive in the January 2020 Order to propose revised effective dates for several tariff records, you explain that NYISO is still working to develop the software applications that will effectuate its DER participation model.  As such, you propose to submit a compliance filing at least two weeks prior to your anticipated effective date for the DER participation model that will specify the date on which the revised tariff language will take effect.  You state that such filing will provide adequate notice to the Commission and market participants of the implementation for integration of Aggregations and DERs.[3]

Pursuant to the authority delegated to the Director, Division of Electric Power Regulation – East, under 18 C.F.R. § 375.307 (2019), your submittal is accepted for filing, effective as requested.

The filing was noticed on February 24, 2020, with comments, interventions, and protests due on or before March 16, 2020.  Pursuant to Rule 214 (18 C.F.R. § 385.214 (2019)), to the extent that any timely filed motions to intervene and any motion to intervene out-of-time were filed before the issuance date of this order, such interventions are granted.  Granting late interventions at this stage of the proceeding will not disrupt the proceeding or place additional burdens on existing parties.   

This acceptance for filing shall not be construed as constituting approval of the referenced filing or of any rate, charge, classification, or any rule, regulation, or practice affecting such rate or service contained in your filing; nor shall such acceptance be deemed as recognition of any claimed contractual right or obligation associated therewith; and such acceptance is without prejudice to any findings or orders that have been or may hereafter be made by the Commission in any proceeding now pending or hereafter instituted by or against NYISO.

This order constitutes final agency action.  Requests for rehearing by the Commission may be filed within 30 days of the date of issuance of this order, pursuant to 18 C.F.R. § 385.713.
