Reference:Tariff Revisions for Balance-of-Period Transmission Congestion Contract Auctions and Credit Requirement Enhancements
On March 13, 2017, New York Independent System Operator, Inc. (NYISO) submitted revisions to its Open Access Transmission Tariff[1] and its Market Administration and Control Area Services Tariff[2] to implement (i) a monthly balance-of-period Transmission Congestion Contract (TCC) auction structure and (ii) enhancements to the credit requirements for TCCs. NYISO states that it intends to replace the existing, monthly reconfiguration auction structure with the proposed balance-of-period auction structure, which will allow market participants the opportunity, on a monthly basis, to adjust their TCC holdings for the remainder of a Capability Period to reflect changes in load serving obligations, market conditions, or both, over time. NYISO also states that the proposed enhancements to TCC credit requirements leverage new pricing data generated by the balance-of-period auctions to adjust collateral holding requirements, so that they more accurately reflect changes in the market value of a market participant’s TCC portfolio over time.[3]
Pursuant to the authority delegated to the Director, Division of Electric Power Regulation – East, under 18 C.F.R. § 375.307 (2016), your submittal is accepted for filing, subject to subsequent compliance filings specifying the effective dates for the relevant revisions, to be made no later than 14 days prior to the proposed effective dates.
The filing was noticed on March 13, 2017, with comments, interventions, and protests due on or before April 3, 2017. Pursuant to Rule 214 (18 C.F.R. § 385.214 (2016)), to the extent that any timely filed motions to intervene and any motion to intervene out-of-time were filed before the issuance date of this order, such interventions are granted. Granting later interventions at this stage of the proceeding will not disrupt the proceeding or place additional burdens on existing parties.
This acceptance for filing shall not be construed as constituting approval of the referenced filing or of any rate, charge, classification, or any rule, regulation, or practice affecting such rate or service contained in your filing; nor shall such acceptance be deemed as recognition of any claimed contractual right or obligation associated therewith; and such acceptance is without prejudice to any findings or orders which have been or may hereafter be made by the Commission in any proceeding now pending or hereafter instituted by or against NYISO.
This order constitutes final agency action. Requests for rehearing by the Commission may be filed within 30 days of the date of issuance of this order, pursuant to 18 C.F.R. § 385.713.
