NOTICE OF EXTENSION OF TIME

 

(September 25, 2012)

 

On September 12, 2012, in the captioned proceeding, the New York Independent System Operator, Inc. (NYISO) filed a motion for extension of time (Motion), until December 12, 2012, for NYISO to issue a revised buyer-side mitigation exemption redetermination (redetermination) for Hudson Transmission Partners, LLC (HTP). NYISO states that it requests this extension so that it and its Market Monitoring Unit (MMU) will have a reasonable time to account for the potential impact of the Commission’s September 10, 2012 Order in Docket No. EL11-50-000[1] on the redetermination for HTP, and for the concurrent posting of notice to stakeholders of the exempt or non-exempt determination and for the MMU’s report, in compliance with the Commission June 22, 2012 Order[2] in the captioned Docket No. EL11-42-000.

 

Notice of NYISO’s Motion was issued on September 13, 2012, with the comment period shortened to and including September 14, 2012.  The New York City Suppliers submitted an answer to the Motion.  They state that the requested three-month extension is inordinately long, and that they would support, instead, an extension of two months, until November 12, 2012, on the condition that no later than that date, NYISO post results of the revised mitigation exemption determinations for the HTP transmission project as well as the revised mitigation exemption determinations for the Astoria Energy II project and the Bayonne Energy Center project. New York City Suppliers also state their conditional support for NYISO’s request for waiver.

 

On September 12, 2012, NYISO also filed, in Hudson Transmission Partners, LLC v. New York Independent System Operator, Inc., Docket No. EL12-98-000, a motion to extend the time required for NYISO’s answer and other parties’ responses in that proceeding to December 12, 2012, so that it may be able to make any adjustments to its answer to account for the potential impact of the September 10, 2012 Order on the HTP redetermination.  Following notice and a comment in opposition to the extension, on September 14, 2012, notice was issued extending the time for filing the NYISO answer and comments in Docket No. EL12-98-000 to and including November 13, 2012.

 

Consistent with the September 14, 2012 notice extending time in Docket           No. EL12-98-000, notice is hereby given that the date for NYISO’s redetermination for HTP is extended to and including November 13, 2012.
