Reference: Compliance Filing Dear Mr. Allen:

Pursuant to authority delegated to the Director, Division of Electric Power
Regulation - East, under 18 C.F.R. § 375.307, your submittal filed in the above
referenced docket is accepted for filing, effective January 13, 2010, as requested.

 

On February 12, 2010, New York Independent System Operator, Inc.

(NYISO) filed Second Revised Sheet No. 91B and Original Sheet No. 91C to its
FERC Electric Tariff, Original Volume No. 2 in compliance with the
Commission’s January 7, 2010 Order.1  The January 7 Order accepted a filing
made by the NYISO on November 6, 2009, but directed the NYISO to submit
revisions to clarify the rules for posting of Day-Ahead Reliability Unit (DARU)
commitments to the NYISO website.  The proposed revisions comply with the
Commission’s directive.

Notice of the filing was published in the Federal Register with comments, protests and interventions due on or before March 5, 2010.  No interventions, comments or protests were filed.

This action does not constitute approval of any service, rate, charge,

classification, or any rule, regulation, contract, or practice affecting such rate or service provided for in the filed documents; nor shall such action be deemed as recognition of any claimed contractual right or obligation affecting or relating to such service or rate; and such action is without prejudice to any findings or orders which have been or may hereafter be made by the Commission in any proceeding now pending or hereafter instituted by or against NYISO.

This order constitutes final agency action.  Requests for rehearing by the Commission may be filed within 30 days of the date of issuance of this order, pursuant to 18 CFR § 385.713 (2009).
